Diversion
Diversion is a program that allows a case to be removed or diverted out of the criminal process for one year. If the person completes the requirements, than the court will dismiss the DUI charge with prejudice.

- No prior convictions for a felony DUI in Oregon or any other jurisdiction;
- No additional pending DUI against you in Oregon or any other jurisdiction;
- No convictions for DUI in Oregon or any other jurisdiction in the last ten years;
- Not currrently in a diversion program or any similar alcohol or drug rehabiliation program, except one that was entered as a result of the present offense;
- No pending charges for any degree of murder, manslaughter, assault from a motor vehicle, or aggravated vehicular homicide in Oregon or any other jurisdiction;
- No participation in any diversion programs or any similar alcohol or drug treament in the last ten years;
- No convictions in the last 10 years for any degree of murder, manslaughter, assault from a motor vehicle, or aggravated vehicular homicide in Oregon or any other jurisdiction;
- At the time of the offiense did not have a commercial drivers license (CDL);
- At the time of the offense was not driving a commercial vehicle;
- Nobody other than youself was injured as a result of the DUI.
- Pay $358 to court in fees;
- Attend and pay ($150) for an alcohol or drug treatment evaluation;
- Complete and pay for recommended treatment;
- If ordered by judge, attend and pay (under $50) for Victims Panel class;
- Do not use any alcohol in conjuction with driving;
- Do not drive without a valid license and insurance;
- Do not commit any crimes or major traffic offenses while in diversion;
- Have your attorney file a motion to have your case dismissed after a year.
